Terms of Service

Welcome to Tensio Design & Civil Consultancy ("Tensio," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our civil engineering consultancy services, website, and related services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

1. Service Description

Tensio provides professional civil engineering consultancy services including but not limited to:

• Structural audits and assessments
• Bill of Quantities (BOQ) preparation and estimation
• Material and cost control services
• Contract management and claim resolution
• Project monitoring and supervision
• Drawing preparation and site inspection
• Structural design and analysis
• Minor works execution
• Turnkey project solutions

2. Service Engagement

2.1 Booking and Consultation

Clients may book services through our website, email, or phone. All service engagements begin with an initial consultation to assess project requirements and scope.

2.2 Service Selection Limit

For bundled service packages, clients may select a maximum of five (5) services per booking. Additional services may be added through separate engagements or package upgrades.

2.3 Quotation and Acceptance

Following the initial consultation, we will provide a detailed quotation outlining the scope of work, deliverables, timeline, and fees. Services commence upon written acceptance of the quotation and receipt of the initial payment.

3. Payment Terms

3.1 Payment Structure

Payment terms vary based on the service type and project scope:

• Consultation Services: Full payment required at the time of booking
• Short-term Projects (under 30 days): 50% advance, 50% upon completion
• Long-term Projects (over 30 days): 30% advance, 40% at mid-point, 30% upon completion
• Turnkey Projects: Custom payment milestones as per project agreement

3.2 Payment Methods

We accept payments via bank transfer, UPI, credit/debit cards, and online payment gateways (Razorpay). All payments must be made in Indian Rupees (INR).

3.3 Late Payment

Payments not received within 7 days of the due date may incur a late fee of 2% per month. We reserve the right to suspend services until outstanding payments are settled.

4. Refund Policy

4.1 Consultation Services

Consultation fees are non-refundable once the consultation session has been conducted. Cancellations made at least 48 hours before the scheduled consultation are eligible for a full refund.

4.2 Project-Based Services

Refund eligibility for project-based services depends on the project stage:

• Before Work Commencement: 90% refund (10% administrative fee)
• After Work Commencement (0-25% completion): 50% refund of remaining balance
• After 25% Completion: No refund; payment for work completed is due

4.3 Refund Processing

Approved refunds will be processed within 10-15 business days to the original payment method. Bank processing times may vary.

4.4 Non-Refundable Items

The following are non-refundable: third-party costs (site visits, material testing, government fees), completed deliverables, and services rendered.

5. Client Responsibilities

Clients agree to:

• Provide accurate and complete information regarding the project
• Grant necessary site access and permissions for inspections and assessments
• Provide all relevant documents, drawings, and reports in a timely manner
• Respond to queries and requests for clarification within reasonable timeframes
• Comply with all applicable laws, regulations, and building codes
• Make payments according to the agreed schedule

6. Intellectual Property

All reports, drawings, designs, calculations, and other deliverables created by Tensio remain our intellectual property until full payment is received. Upon full payment, clients receive a non-exclusive, non-transferable license to use the deliverables for the specific project only.

Clients may not reproduce, modify, or distribute our deliverables without prior written consent. Tensio retains the right to use project information for marketing and portfolio purposes, subject to client confidentiality agreements.

7. Liability and Warranties

7.1 Professional Standards

We provide services in accordance with professional engineering standards and applicable codes. However, we do not guarantee specific outcomes or results.

7.2 Limitation of Liability

Our liability for any claim arising from our services is limited to the total fees paid for the specific service in question. We are not liable for indirect, consequential, or incidental damages.

7.3 Third-Party Actions

We are not responsible for actions or omissions of contractors, builders, or other third parties engaged by the client.

8. Confidentiality

We maintain strict confidentiality of all client information and project details. Information will not be disclosed to third parties without client consent, except as required by law or professional regulations.

9. Termination

Either party may terminate the service engagement with 15 days written notice. Upon termination, the client is responsible for payment of all work completed up to the termination date. We will provide all completed deliverables upon receipt of payment.

10. Dispute Resolution

Any disputes arising from these Terms or our services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996, in Mumbai, Maharashtra, India.

11. Governing Law

These Terms are governed by the laws of India. The courts of Mumbai, Maharashtra shall have exclusive jurisdiction over any disputes.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Continued use of our Services after changes constitutes acceptance of the modified Terms.
